Congress has consistently provided special protection to borrowers who secure loans with their home. And this has never been more true than it is today. As a result, real estate lending is by far the most complex and confusing type of lending. Comprehensive coverage of the real estate lending requirements of each regulation is provided, along with policy suggestions, employee training tips, audit techniques and steps to eliminate past problems. Emphasis is placed on coverage and exemption rules, determining which disclosures are required and the content of the required disclosures. Every year major changes appear and this year is no exception, with the recent major revisions to Regulation Z and RESPA leading the list.
The following regulations are covered:
- Equal Credit Opportunity Act (Regulation B)
- Fair Housing Act
- Home Mortgage Disclosure Act (Regulation C) – includes a review of new pricing data (effective October 1, 2009)
- Homeowners Protection Act
- Flood Disaster Protection Act – updated for the new Interagency Questions and Answers
- Fair Credit Reporting Act – includes a review of the new Accuracy and Integrity rules (Effective July 1, 2010) and the new risk-based pricing notice (effective January 1, 2011);
- Truth in Lending Act (Regulation Z) - includes a review of the major new rules (new early TIL disclosure rules, new Higher-Priced loans, escrow requirements, and new servicing rules) (Effective on various dates from July 30, 2009 to April 1, 2010)
- Real Estate Settlement Procedures Act (Regulation X) – includes a review of the major revisions (new GFE, HUD-1/A, and Servicing Disclosure Statement) to Regulation X (Effective January 1, 2010)
- Secure and Fair Enforcement for Mortgage Licensing Act (SAFE Act) – registration of mortgage department personnel
- Helping Families Save Their Homes Act
The program is designed for Compliance Officers, Loan Officers, Loan Processors and Auditors.
